After the end of the state of alarm last Sunday, May 9, all the Autonomous Communities have lifted the perimeter closure of their territory. However, there are regions which maintain the perimetral closure in some municipalities or areas of high incidence, and others the night curfew.
It should be remembered that the state of alarm served as a legal guarantee for the autonomous governments to apply mobility restrictions, such as the closure of the entire community or curfews at night.
However, the Government, by decree, has modified the law regulating administrative litigation, including the possibility that the communities can apply limitations that violate fundamental rights by judicial authorization.
Thus, in the event that the proposed measures are rejected by the higher courts, they may appeal to the Supreme Court, which will review whether or not they should be imposed. For this purpose, this body is already coordinating, as it must respond within five days, in order to expedite the process.
Andalusia and its almost 8.5 million inhabitants will not be able to leave the region for ten days and until next November 9. The new restrictions also include the perimeter closure of the provinces of Granada, Jaén and Seville, in alert level 4, and of all their municipalities, which will not be allowed to enter or leave without a justified cause. Also affected by the perimetral confinement are the localities of the sanitary areas of Córdoba Sur -the city of Córdoba was already confined-, Jerez Costa Noroeste, Sierra de Cádiz and La Vega de Antequera.
Aragón has perimetrically confined the whole territory, as well as the cities of Zaragoza, Huesca and Teruel. This measure will be applied from last Tuesday until November 9, and the confinement of the three provincial capitals will be maintained with respect to the rest of the Aragonese territory, as well as the curfew schedule set by the Government, from 11:00 p.m. to 6:00 a.m., and the closure of the hotel and catering business at 10:00 p.m.
For its part, the Public Prosecutor’s Office will study case by case the application of the restrictions agreed by the autonomous governments, so that it will not establish a general criterion of action, since it wants that position to be fixed as soon as possible by the Supreme Court, which from May 9 will have the last word.
For the moment, until May 9, the curfew is in force in the Community of Madrid from 11:00 p.m. to 6:00 a.m., as well as the prohibition of meetings of non cohabitants in homes, except for exceptions such as care for elderly dependents, minors or vulnerable persons. In addition, the Community of Madrid maintains its strategy of restricting mobility in areas with a high incidence of coronavirus, measures which are in force in 16 basic health areas and two localities in which 451,949 citizens live, 6.7% of the population of the region.
Judicial ratification after the state of alarm would only be necessary for measures affecting fundamental rights, such as mobility restrictions, and not for others related, for example, to time or capacity limitations.
New York announces new measures to try to ensure that anyone arriving in the city from the UK complies with the two-week quarantine, which will include police visits and fines of $1,000 per day for non-compliance.
Although New York already imposed a quarantine on people arriving from abroad, measures will now be stepped up to ensure compliance. Thus, all travelers will receive official notification by registered mail of their obligations and, in the case of those arriving from the United Kingdom, there will be police visits to homes and hotels to ensure that the quarantine is respected.
These data come after Health Minister Matt Hancock warned that a second mutated strain of the coronavirus has been detected which is apparently more contagious than the versions known so far.
The Madrid City Council will grant in 2021 a total of 5 million euros in direct aid to cabs, “the first time this type of aid is given”, announced the delegate of Environment and Mobility, Borja Carabante, in the municipal plenary session.
